i am trying to find a track played by scorpio, producer and marc smith back in the day something like..
1 2 3 4 5 6 7 8 9 then something about battle for the mind. quite dark sounding

This won't be the tune ID but if you skip to 2:50 is that the sample you're on about? If so it might help narrow the one ID down.

that vocal is the same sample but the track they used was much darker

you make it sound like they are special. There where HUNDREDS of people who made music on amiga or c64. Just look at Mod Archieve. Most of those tracks are from before 1998.
And Gabber / Dutch Hardcore is fairly common, maybe not in the highest qualities of samples

not at all, just fellow Aussies and the fact people playing a MOD on vinyl always seemed weird to me for whatever reason :)

wouldnt surpise me alot of DJ erez from Shiva Shidapu/Infected Mushroom fame has released alot of mod tracks converted to wave form. Heck, one obvious one is Shiva Shidapu - Aquamarine.
