Rather use kicks from certain sample packs, and EQ and comp them if you need. Sampling from tracks you'll get kicks that were already put through track's final mastering process, so that in the end you'll have double mastering effect on kicks.

I said "if you need" probably with a small grammar mistake. Compressed indeed, but not always equalized good enough.

Ive got the vengeance club sounds 2 pack, how would you go about making a kick for a hardcore track from there?
Is one kick drum sample on its own enough? because I know quite a few people layer them, either 2 or 3 samples.
Do the big producers really just pick a sample, and not do much processing on it?

the one thing you gotta watch with the kick drum is the tail, you want a short sharp kick, that wont interfere with the bass & it's frequencies.
if you're using a vengeance sample pack for eg, in the kick folder:
go to >view>sort by>size
if size isn't an option:
go to >view>sort by>more & select 'size'
this will sort your kicks to length, shortest first (phenex taught me that lil trick)
do the same with the slappy trance kicks & experiment layering them together with some eq so they dont clash.

Why sample a kick from a song when there is hundreds of free kicks out there?
Check out k-complex's sample pack, its free with about 40 awesome kicks tailored for hardcore.

To actually answer your question. It is illegal but there will never be any legal repercussions for sampling a kick so don't worry about it. ;) Loads of people do it all the time. Don't feel you can't rip a kick from something rather than using a kick from a sample pack either... I've done several tracks using kicks sampled from vinyl!

Layer a low, phat kick, eq some of the hi end off it. Then get a clucky, short kick, eq some of the bottom end off and layer them together.
Experimentation is the key.

I recently started using non-typical Kick samples. They're more fun
